The letter revoking a power of attorney — at any time and without reasons (§ 1020 of the Austrian Civil Code, ABGB) — and asking for the document back. It is also the notice to banks, authorities and other parties: anyone who, through no fault of their own, does not know the power has ended is protected (§ 1026 ABGB), so each receives a copy. It takes effect on receipt — hand it over against a signature or send it by registered post. It cannot end a registered lasting power (Vorsorgevollmacht), which ends only on entry in the ÖZVV register. In German.

Common questions
- Can a power of attorney be revoked at any time in Austria?
- Yes. Under § 1020 ABGB the principal may revoke the power at any time and without giving reasons. The revocation takes effect when it reaches the agent. The law prescribes no form, but in writing with proof of receipt it can be proved: hand the letter over against a dated signature on a copy, or send it by registered post, ideally for delivery to the addressee only (Eigenhändig). An ordinary letter does not prove receipt (OGH 2 Ob 108/07g).
- Why must banks and authorities in Austria also be told of the revocation?
- Because § 1026 ABGB protects third parties: if the agent still makes a deal after the power has ended with someone who, through no fault of their own, did not know, it stands, and your only claim is against the agent. So send every body that knows of the power — bank, insurer, landlord, authority — a signed copy of the letter and ask them to confirm receipt.
- Can this letter revoke a lasting power (Vorsorgevollmacht) in Austria?
- Not on its own if the lasting power is registered in the Austrian central register of representation (ÖZVV): it ends only once the revocation is entered there, and only a notary, a lawyer or an adult-protection association can enter it (§ 246 ABGB). For the revocation itself it is enough to make clear that you no longer want to be represented. The same applies to a chosen adult representation. The letter can still inform the agent and third parties.
