The out-of-court notice (εξώδικη δήλωση) by which someone in Greece revokes an authorisation or power of attorney they gave: it describes the authority, revokes it from service, asks for the original back and an account, and names the third parties being told. Under the Greek Civil Code the authority ends on a revocation declared to the agent or the third party (arts. 218–219), so proof matters: a court bailiff (δικαστικός επιμελητής) serves it, and the report of service proves content and date. A notarial power of attorney is revoked only by notarial deed (art. 220); the notice is then served together with the notary's deed.

Common questions

Why is the revocation of a Greek authorisation served by a court bailiff?
The authority to act ends on a revocation declared to the agent or to the third party (arts. 218–219 of the Greek Civil Code), so what reached the recipient, and when, is what counts. A court bailiff (δικαστικός επιμελητής) serves the out-of-court notice and draws up a report of service that proves its content and date beyond dispute. An ordinary or registered letter proves less. Give the bailiff the signed notice and copies for everyone it is to be served on.
Should the bank and public offices in Greece be told about the revocation?
It is wise. The revocation can also be declared to the third party the agent deals with (art. 219 of the Greek Civil Code), and a third party who did not know of it may argue that they dealt in good faith. Send a copy of the notice to the bank, the tax office or anyone else who accepts the authorisation, or ask the bailiff to serve it on them too. The document has a field to name them.
How is a Greek notarial power of attorney revoked?
Only by notarial deed: an authority given by notarial document can be revoked only in the same form (art. 220 of the Greek Civil Code), and the revocation takes effect when it reaches the agent or the third party. Have a notary draw up the deed of revocation, enter its details in the field this document has for it, and give both to the court bailiff to serve together. If the power was given as irrevocable, because it also serves the agent's or a third party's interest, it can be revoked only for serious cause: consult a lawyer.
