- Complaint to a bank about payments, an account, a card or a loan (Austria)Your written complaint to a bank in Austria — about a faulty transfer, a card payment, charges, a blocked account, a basic payment account (Basiskonto), a loan or an investment. It sets out what happened and the remedy you want, and sets the deadline for the answer: for payment services 15 business days, exceptionally 35 (§ 97 of the Austrian Payment Services Act, ZaDiG 2018). Complaining to the bank first is also the condition for a procedure before the joint conciliation body of the Austrian banking industry; a complaint to the Financial Market Authority (FMA) remains open alongside. In German.
- Complaint against a penalty decision to the Land administrative court (Austria)A complaint against an Austrian penalty decision (Straferkenntnis), for instance after a traffic offence, to the Land administrative court – in Vienna the Verwaltungsgericht Wien – lodged with the authority that issued the decision: with everything § 9 of the Austrian Administrative Court Procedure Act (VwGVG) requires (decision, authority, grounds, request, timeliness), evidence offered and a request for an oral hearing. Deadline: four weeks from service (§ 7 Abs 4 VwGVG). The penalty cannot be raised (§ 42 VwGVG); if the complaint fails, 20 % of the penalty is added in costs, at least € 10 (§ 52 VwGVG). In German.
- Claim against a social insurer's decision (Austria)The claim at Austria's Labour and Social Court (Arbeits- und Sozialgericht) against a decision (Bescheid) of the ÖGK, SVS, BVAEB, PVA or AUVA — on care allowance, a reimbursement or insurance periods, for instance: with claimant and defendant, the decision, the facts, the evidence and the relief sought. It must be filed within four weeks of service, or three months in pension and care-allowance matters (§ 67(2) ASGG); a claim filed in time sets the decision aside as far as claimed. No lawyer is needed at first instance and insured persons bear no risk of costs (§ 77 ASGG). In German, to print, sign and file by post or through JustizOnline.
- Complaint to a trader with a deadline before conciliation (Austria)Your written attempt to settle with a trader in Austria before turning to a conciliation body: which contract, what went wrong, what you ask for and by when. The recognised conciliation bodies — the Verbraucherschlichtung Austria, the Internet Ombudsstelle and the sector bodies — may refuse a case that was not first raised with the trader, or that is filed more than a year afterwards (Austria's Alternative Dispute Resolution Act, AStG). This complaint is that first step, and your proof of it. In German.
- Price reduction or termination of the sale for a defect (Austria)The declaration to the seller when repair or replacement of defective goods has failed, in Austria: you claim an appropriate price reduction or termination of the sale (formerly Wandlung), giving the ground, the amount, a payment deadline and your account. Under § 12 of the Austrian Consumer Warranty Act (VGG) for consumer purchases from 2022 and § 932 of the Austrian Civil Code (ABGB). Termination is excluded for a minor defect; a price reduction remains. After termination the seller pays for the return. The rights must reach a court within three months after the warranty period ends (§ 28 VGG). In German.
- Complaint about a bank to the Financial Market Authority, FMA (Austria)Your complaint to Austria's Financial Market Authority (FMA) about a bank that advised you wrongly, charged you incorrectly, refused a basic payment account or left a complaint unanswered. The FMA also offers its own complaint form on its website, free of charge. This letter is the alternative for post: it names the company, what happened, your complaint to it and the outcome, and encloses the company's statement. The FMA acts in the interest of consumers as a whole and does not obtain a solution for your individual case — that is what the banks' joint conciliation body is for. In German.
- Complaint against a tax assessment (Austria)The complaint (Bescheidbeschwerde) against an assessment of Austria's tax office, the Finanzamt Österreich — an income tax or VAT assessment, for example — under § 243 of the Austrian Federal Fiscal Code (BAO), due within one month of service (§ 245 BAO). It contains what § 250 BAO requires: the assessment, the points contested, the changes sought and the grounds. Optional: suspension of collection (§ 212a BAO), since a complaint does not stop payment, direct referral, an oral hearing and a panel at the Federal Fiscal Court. Submit through FinanzOnline, by post or fax: an e-mail is no submission at all (§§ 85, 86a BAO). In German.
- Objection to a payment order (Austria)An objection (Einspruch) to a conditional payment order from the Austrian Mahnverfahren (§ 248 of the Austrian Code of Civil Procedure, ZPO), with the case number (Geschäftszahl), the claimant, the amount and the date of service. The deadline is four weeks from service and cannot be extended; at a Bezirksgericht an objection without reasons and without a lawyer is enough (§ 448 ZPO), and a hearing follows. If the order itself says a lawyer and a full defence are required, this letter is not the right one. Not by e-mail: file it by post, in person at the court or through JustizOnline with ID Austria. In German.
- Notice of a defect: demand for repair or replacement (Austria)The notice to the seller when goods you bought are defective, in Austria: you rely on the statutory warranty (Gewährleistung), ask at your choice for repair or replacement, and set a dated deadline. Under the Austrian Consumer Warranty Act (VGG) for purchases from 2022 and §§ 922 ff of the Austrian Civil Code (ABGB), with the first-year presumption (§ 11 VGG). Note: the rights must be taken to court no later than three months after the warranty period ends; the letter alone does not stop that clock. In German, ready to sign and send by registered post or e-mail.
- Objection to a penalty order (Austria)A letter objecting to an Austrian penalty order (Strafverfügung) from a district authority, a city's Magistrat or the Land police directorate, for instance for a traffic offence: with the file number, the date and the day of service, against the whole order or expressly only against the amount (§ 49 of the Austrian Administrative Penal Act, VStG). Deadline: two weeks from service; no reasons are needed, e-mail is accepted, and posting on the last day is enough. If the case ends in a penalty decision, 10 % costs are added, at least € 10 (§ 64 VStG). On-the-spot fines and anonymous orders cannot be objected to. In German.
- Objection to a mobile or internet bill (Austria)A written objection to a bill from your mobile, landline or internet provider in Austria: with the bill's number and date, the amount disputed and the reasons, such as unknown premium services, roaming, data use or charges billed twice. You ask for the charges to be reviewed and confirmed or corrected in writing (§ 145 of Austria's Telecommunications Act, TKG 2021), with an itemised bill, and pay the undisputed part. Object within three months of the bill; it opens the way to free conciliation at the RTR, Austria's telecoms regulator. In German.
- Package holiday claim: price reduction, damages and lost holiday enjoyment (Austria)The complaint to the tour organiser after a package holiday that went wrong, in Austria: you claim an appropriate price reduction for each period affected, damages and, for a substantial lack of conformity, compensation for lost holiday enjoyment (§ 12 of the Austrian Package Travel Act, PRG), with the total, a payment deadline and your account. The letter refers to your notice given on the spot (§ 11 Abs 2 PRG) and announces conciliation or court action. In German, with your receipts, photos and the rep's confirmation enclosed.
- Request to inspect receipts, and objections to a service-charge statement (Austria)The letter to an Austrian landlord or property manager when the annual statement of Betriebskosten (service charges) raises questions: it asks to inspect the invoices, contracts and the split between flats, lists the items you dispute now, asks for a corrected statement and pays any disputed balance only under reservation. Where the Austrian Tenancy Act (MRG) applies in full, the statement is due by 30 June and the receipts must be open to inspection (§ 21 Abs 3 MRG). In German.
- Complaint about medical treatment (Austria)One letter for five routes in Austria after medical treatment you are unhappy with: a complaint to the practice or hospital itself; a request to the patients' advocate (Patientenanwaltschaft) of the Land where it is, to examine and mediate; an application to the medical chamber's conciliation board (Schlichtungsstelle); an application to the Land's patient compensation fund for harm in hospital; and a report to the disciplinary prosecutor at the Austrian Medical Chamber. A written request to the advocate or the board suspends limitation from its arrival, for up to 18 months (§ 58a ÄrzteG 1998, the Austrian Physicians Act). In German.
- Disputing an unauthorised payment or card payment with your bank (Austria)A letter to your own bank in Austria when your account or card was charged without your consent — after card fraud, phishing or a double charge — or when you paid by card and received nothing (chargeback). You dispute the transactions and claim the refund that the bank must make by the end of the following business day at the latest under the Austrian Payment Services Act (§ 67 ZaDiG 2018). Report without undue delay, and within 13 months of the debit at the latest (§ 65 ZaDiG 2018). With the date the card was blocked, the police report and the next step: the banks' joint conciliation body. In German.
- Complaint to an electricity or gas supplier or network operator (Austria)A complaint letter to your electricity or gas supplier, or to the network operator, in Austria — about a wrong annual bill, instalments set too high, a meter reading, a switch of supplier or a threatened disconnection. With your customer number, metering point number and supply address, the problem, the remedy you want and a deadline for the answer. Complaining to the company first is what opens the free conciliation at E-Control, Austria's energy regulator (§ 26 E-ControlG). Under Austria's new Electricity Act (ElWG) and Gas Act (GWG 2011). In German.
- Notice of a defect in a rented flat, with rent reduction and a demand for repair (Austria)The letter a tenant in Austria uses to report a defect in the flat — mould, a broken boiler, water damage, leaking windows — and to demand repair by a date. It states that the rent is reduced by law for as long and as far as use is impaired (§ 1096 of the Austrian Civil Code, ABGB) and lets you choose: keep paying in full under an express reservation to reclaim, the safer course, or pay the reduced rent. You enter the percentage yourself. In German, for every Land; print, sign and send by registered post.
- Air passenger rights: compensation for delay, cancellation or denied boarding (Austria)The claim letter to the airline when your flight reached its destination at least three hours late, was cancelled at short notice, or you were denied boarding: you claim compensation of €250, €400 or €600 per passenger under Article 7 of Regulation (EC) No 261/2004, plus costs you paid for meals and accommodation, with a payment deadline and your account. If the airline does not answer, or answers unsatisfactorily, within six weeks, Austria's Agency for Passenger Rights (apf) helps free of charge; this letter is the first step there. In German.
