Common questions
- Until when can a French tax notice be disputed?
- For income tax, until 31 December of the second year after the year it was put into collection (article R. 196-1 of the French Tax Procedures Book): a notice collected in 2026 can be disputed until 31 December 2028. For property tax and the council tax on second homes the time is shorter: until 31 December of the year after collection (article R. 196-2). The collection date is printed on the notice.
- What if the French tax office does not answer the complaint?
- It has six months, extended by up to three if it tells you before they run out (article R. 198-10 of the French Tax Procedures Book). Its silence is not acceptance: with no decision six months after the complaint was lodged, you may go to the administrative court. If it rejects the complaint, you have two months from notification of its decision to go to court (article R. 199-1). Before the court you may also ask the departmental tax conciliator for a fresh look, which does not stop that time running.
- Must the disputed French tax be paid while waiting for the decision?
- Yes, unless you ask for a stay of payment in the complaint (article L. 277 of the French Tax Procedures Book), which the letter provides for. If the disputed tax exceeds €4,500, the accountant may then ask for guarantees; the undisputed part stays due on the deadline. If the reduction is granted, the overpaid tax is refunded with default interest (article L. 208). Without a stay, a late-payment surcharge may apply to the unpaid sum.
