Common questions
- How long does a taxpayer have to object to a Moldovan State Tax Service decision?
- 30 days from the day the decision was communicated or notified to you (art. 267¹ of the Tax Code). Sent by post, the objection is in time if you handed it in at the post office as a registered letter before the deadline ran out (art. 73 of the Administrative Code). If you could not meet the deadline for reasons beyond your control, choose the request to be reinstated in time in the document, give the reasons and attach the evidence.
- How long does Moldova's State Tax Service have to decide on an objection?
- 30 days from receiving it; the SFS management may extend this by at most 30 days, but must tell you (art. 267³ of the Tax Code). That is why the objection should be filed with a registration number or by registered post with acknowledgement of receipt: the time to answer runs from the date it is received.
- What can a taxpayer in Moldova do if the State Tax Service rejects the objection?
- You can challenge the decision on your objection in the administrative court. The decision must state the remedy, the court and the deadline; the Administrative Code's general rule is 30 days from its communication or, if no decision comes, from the end of the time allowed to decide, and a year if the decision does not state the remedy (art. 209). Keep the envelope or other proof of the date you received it.
- Can an objection to Moldova's tax service be e-mailed instead of filed in person?
- Yes, if you sign it with a qualified electronic signature — MSign, a mobile signature or the identity card's certificate: an electronic petition must carry an electronic signature (art. 75 of the Administrative Code). Otherwise, file it signed by hand at the SFS registry and ask for a registration number on your copy, or send it through Poșta Moldovei by registered post with acknowledgement of receipt.
