Common questions
- How long do I have in Moldova to dispute a card payment I did not make?
- Tell the bank as soon as possible, and within 13 months of the date the account was debited at the latest; the limit does not apply if the bank did not give you the information about the payment (art. 56(1) of Law no. 114/2012 on payment services and electronic money). If the card was lost or stolen, have it blocked at once, by phone or in the app: after that notice you are not liable for payments made with it, unless you acted fraudulently (art. 58 of Law no. 114/2012).
- Do I bear any loss in Moldova if my card was stolen?
- The bank refunds an unauthorised payment at once. If you did not keep the card's security details, such as the PIN, safe, you bear the losses until you tell the bank, up to the amount agreed with it but no more than 2,500 lei. You bear all the losses only if you acted fraudulently or broke your duties for the card intentionally or with gross negligence, and the bank must prove the fraud or gross negligence (arts 57 and 58 of Law no. 114/2012).
- What can I do in Moldova if the bank refuses to refund an unauthorised payment?
- The bank gives you its decision within 15 working days of receiving the complaint; in exceptional cases it may send a provisional answer giving the reasons for the delay, but the final answer comes within 35 working days at most. If it does not answer, or you disagree, you can petition the National Commission for Financial Markets (CNPF), through cnpf.md, or go to court (art. 105 of Law no. 114/2012). If you authorised the payment but the trader did not deliver, it is not an unauthorised payment: ask the bank to dispute it through the card scheme's chargeback procedure.
