Common questions

When can a Moldovan creditor apply for a court order for a debt?
For the claims listed in art. 345 of the Code of Civil Procedure, which include a claim based on an act in simple written form, such as a loan contract or a receipt signed by the debtor; one application covers one claim. It is filed at the district court (judecătorie). For other debts, or where that procedure does not fit, the route is an ordinary claim at the same court.
What late-payment interest can be claimed on a debt that is overdue in Moldova?
The late-payment interest of art. 942 of the Moldovan Civil Code: the National Bank of Moldova's base rate in force on 1 January or, for the second half of the year, on 1 July (art. 874), plus 5 percentage points a year where the debtor is a consumer and plus 9 points in other cases. A consumer is an individual acting outside their trade or profession towards a professional (art. 3), so between two individuals who are not professionals it is 9 points. It runs from the day after the due date until actual payment; the base rate is on bnm.md.
How should the demand be sent so that its receipt can be proved?
Through Poșta Moldovei by registered letter with acknowledgement of receipt: the card signed by the debtor shows the date received, from which the 15 days run. Keep a copy of the demand, the postal receipt and the card for the court file. You can also hand it over in person and ask the debtor to sign and date your copy.
