Common questions

What can a Moldovan business claim from a customer who does not pay an invoice?
The invoiced amount; the late-payment interest of art. 942 of the Moldovan Civil Code — the National Bank of Moldova's base rate in force on 1 January or, for the second half-year, on 1 July (art. 874), plus 9 percentage points a year — from the day after the due date until payment; and the minimum compensation for recovery costs, the lei equivalent of 20 euro at that day's National Bank rate (art. 945). If the contract has a late-payment penalty, the creditor chooses the penalty or the interest.
What comes next if a Moldovan business debtor ignores the demand?
The creditor can ask the local court (judecătorie) for a court order (ordonanță judecătorească, art. 345 of the Civil Procedure Code), a procedure for claims arising, among others, from a legal act in simple written form, one claim per application; or it can bring an ordinary claim at the competent court. The claim must be brought within the general three-year limitation period (art. 391 of the Moldovan Civil Code).
How should a payment demand be sent in Moldova so that receipt can be proved?
Through Poșta Moldovei by registered letter with acknowledgement of receipt: the card signed by the addressee comes back to you and shows the date of receipt, from which the payment period in the demand runs. You can also hand it in at the debtor's office and ask for a registration number or a signature of receipt on your copy. Keep a copy of the demand and of the invoices attached.
