Common questions
- Who can register as an independent entrepreneur in Moldova?
- Since 1 January 2026, a resident individual who personally provides the services listed in the annex to chapter 10⁴ of the Moldovan Tax Code can register free of charge, online, with the Public Services Agency, using a qualified electronic signature (Law no. 228/2025); ASP assigns an IDNO within 24 hours. The single tax, which also covers social and health contributions, is 15% of income up to 1,200,000 lei a year and 35% above it. The contract records the IDNO and the registration date.
- What makes a Moldovan freelancer contract different from an employment contract?
- How the work is done, not only the title. The provider chooses the hours, place and means, is not subordinate to the client (art. 1329 of the Moldovan Civil Code) and may work for others. If the work is in fact done as an employee's, the relationship may be treated as employment, and the State Labour Inspectorate (ISM) checks undeclared work. Separately, art. 24(11¹) of the Tax Code sets when the client may deduct payments to an independent entrepreneur; relationships outside its conditions are taxed as employment.
- How is a contract with a Moldovan freelancer signed?
- In writing, in two copies, one for each party, signed by hand by the provider and the client's representative. It can also be signed at a distance with a qualified electronic signature (MSign, a mobile signature or the identity card's certificate), which has the effect of a handwritten one (Law no. 124/2022).
