Common questions
- What interest does a business client owe for paying late in Moldova?
- The late-payment interest of art. 942 of the Moldovan Civil Code: the National Bank of Moldova's base rate in force on 1 January or, for the second half-year, on 1 July (art. 874), plus 9 percentage points a year, from the day after the due date until payment. Between businesses, the minimum compensation for recovery costs, the lei equivalent of 20 euro, is added (art. 945). If a penalty was agreed, the creditor chooses either the interest or the penalty.
- What payment term can two businesses in Moldova agree for services?
- At most 60 days from receipt of the invoice, of the services or, where an acceptance procedure was agreed, from acceptance; a longer term only if it is expressly stipulated and not grossly unfair to the provider (arts 862 and 1080 of the Moldovan Civil Code). Where the client is a public authority, the term is at most 30 days, or 60 if the nature of the contract justifies it. With no term in the contract, payment is due within 30 days of receiving the invoice. The contract lets you write the number of days.
- When is VAT added to the price of services between Moldovan businesses?
- When the provider is registered for VAT. Since 1 March 2026 registration is compulsory above 1,700,000 lei of supplies in 12 months; below that, the provider need not be registered. The contract states the price before VAT, and VAT is added only if the provider is registered. Ask the other business to confirm in writing whether it is VAT-registered.
- How can a Moldovan service agreement be ended early?
- By rezoluțiune, declared in a written notice (art. 921 of the Moldovan Civil Code). The contract gives two routes: either side, with the notice you set, or the side affected by a material breach not put right within 15 days of notice (art. 917). Services provided until the end are paid for. The client may end the contract at any time, but without good reason owes damages (art. 1348). Send the notice through Poșta Moldovei by registered post with acknowledgement of receipt, or hand it over against signature.
