The fixed-term employment contract between an employer and an employee in Moldova, with the same art. 49 terms as an open-ended one and what sets it apart: the date or event on which it ends, within five years of the start (art. 54 of the Moldovan Labour Code), the ground from the closed list of art. 55 — such as replacing an absent employee, seasonal work or a specific task — and the shorter probation of art. 61. Common questions

When may a fixed-term employment contract be used in Moldova?
Only in the cases listed exhaustively in art. 55(1) of the Moldovan Labour Code, for example replacing an absent employee, temporary or seasonal work, a specific task, staff posted abroad, pensioners, or the head of the unit and the chief accountant. The ground is written in the contract.
What is the longest a fixed-term employment contract can run in Moldova?
Five years (art. 54 of the Moldovan Labour Code). A fixed-term contract made without one of the grounds of art. 55 counts as open-ended, so the ground box should not be left vague. The contract ends on the date or at the event written in it (art. 82), unless work in fact carries on and neither party has asked for it to end. If the parties want to carry on, they sign an addendum or a new contract in writing.
What probation can a fixed-term employment contract in Moldova set?
At most 15 calendar days for a contract of three to six months, and at most 30 calendar days for one longer than six months (art. 61 of the Moldovan Labour Code); for a contract shorter than three months, art. 61 provides no probation. Probation exists only if the contract states it, and sick leave and other justified absences do not count towards it. Leave the box empty if there is to be no probation.
