Common questions
- Does a fixed-term contract of employment in Austria need a reason, and how often may it be renewed?
- Not for the first fixed term: Austrian law sets no maximum length, no reason and no statutory form; writing serves as proof. Successive fixed terms (chain contracts) need an objective justification, such as a specific replacement, genuine seasonal work or a funded project; an unforeseeable economic development is not enough (OGH 9 ObA 17/24a). Without one, the employment counts as open-ended. Enter the justification in the contract.
- Can a fixed-term employment in Austria be ended early by notice?
- Only if the contract allows notice, and only if the term is long enough for that to stay proportionate: a 14-day period was accepted for a term of six months or a year, but not for one of about three and a half months. Otherwise the only routes are ending it by agreement or for an important reason (dismissal for cause, resignation for cause). An employee bound for more than five years may give six months' notice after five years (§ 21 AngG, § 1158 Abs 3 ABGB).
- What does Austria's Maternity Protection Act (MSchG) say if a pregnancy becomes known during a fixed-term employment?
- The expiry of the fixed term is suspended from the notification of the pregnancy until the employment ban before birth begins (§ 10a MSchG). This does not apply if the fixed term is objectively justified — for a replacement, for training, for a season or as an extended probation — or prescribed by law. A pregnancy notified only after the term has ended has no effect. That is why the contract records the reason for the fixed term.

The written notice an employee in Austria gives the employer on going on sick leave (Krankenstand): when the incapacity began, how long it is expected to last and its cause — illness, accident, work accident or occupational disease — but never a diagnosis. Under the Austrian Salaried Employees Act (§ 8 Abs 8 AngG) and Continued Remuneration Act (§ 4 Abs 1 EFZG) the absence is reported without delay, and the confirmation of incapacity (Arbeitsunfähigkeitsbestätigung) shown when the employer asks. An employee in Austria who falls ill on holiday does not lose the days: if the illness lasts more than three calendar days, the days of incapacity are not counted against the holiday entitlement (§ 5 UrlG, the Austrian Holiday Act). The employer must be told without delay after three days, and a doctor's confirmation shown on returning to work. This letter records both, with the holiday dates and the start and expected length of the incapacity, without a diagnosis — and a choice for illness abroad, where an official confirmation or a hospital's confirmation is needed. The notice telling an employer in Austria that you are taking care leave (Pflegefreistellung) under § 16 UrlG, the Austrian Holiday Act: to nurse a sick close relative or a sick member of your household, to look after your child when the person who normally cares for it is unavailable, or to stay with a child under ten in hospital. You choose whether this is the first week, the second week for a child under twelve who falls ill again or, once both are used, holiday taken without agreement (§ 16 Abs 3 UrlG).
