Common questions

How long is paternity leave in Moldova, and by when must it be requested?
Up to 15 calendar days for each newborn child, so with twins the right counts for each child (art. 124¹ of the Moldovan Labour Code, as amended by Law no. 156/2025, in force from 1 July 2025). The father requests it in writing within 12 months of the birth, with a copy of the birth certificate; he may also take it in three parts of 5 days within those 12 months. The paternity allowance is paid from the state social insurance budget, on the conditions the law sets.
Who can take partially paid childcare leave in Moldova until the child is three?
After maternity leave, partially paid leave until the child turns three is granted on written request to one of the parents, a grandparent, another relative actually caring for the child, or the guardian (art. 124 of the Moldovan Labour Code). The allowance is paid from the state social insurance budget, through the National Social Insurance House (CNAS).
How is a childcare or paternity leave request handed in, and with what?
The request is made in writing with a copy of the child's birth certificate; fill in only the part for the leave you want, and the other does not appear. Hand two copies to the employer and ask for the registration number and date to be written on yours; if it is not registered, send it through Poșta Moldovei by registered letter with acknowledgement of receipt. The leave is granted by the employer's order.

The letter can also propose ending earlier by written agreement. It is handed in for registration or sent by registered post with acknowledgement of receipt.

It is handed in for registration or sent by registered post with acknowledgement of receipt, and proves that payment was asked for before a petition to the State Labour Inspectorate.

  • Complaint to the State Labour Inspectorate (Moldova)

The petition by which an employee or former employee reports an employer's breaches to Moldova's State Labour Inspectorate — unpaid wages, work without a written contract, overtime, refused leave, safety at work — and asks for an inspection and a written answer.
