Common questions

How long is child-raising leave in Romania?
Until the child turns 2 or, for a child with a disability, 3 (Emergency Ordinance no. 111/2010). For that time the employment contract is suspended at the employee's request (art. 51 of the Labour Code), and on return the employee resumes the same job.
Does the request to the employer also claim the allowance?
No. The request to the employer obtains the suspension of the contract; the monthly allowance is claimed separately, at the town hall where the parent lives, with the documents the law requires, and the file goes to the county agency for payments and social inspection. The employer issues the income certificate that file needs.
Can an employee on child-raising leave be dismissed?
No. The Labour Code forbids dismissal during child-raising leave for a child under 2 or, for a child with a disability, under 3 (art. 60), except where the employer is in judicial reorganisation, bankrupt or being wound up.
