Leave under Art. 164 of the Labour Code is taken after maternity leave and is granted on an application to the employer, while the benefit is paid by the social security institute through a separate procedure. Can the father take this leave instead of the mother?

Yes — on certain conditions the leave transfers to the other parent, and in some cases to a grandparent. That is why the application has a field for the capacity you are claiming in; a transfer also needs the consent of the person giving it up.

Does my employer pay me during this leave?

No. The benefit is paid by the social security institute through a separate procedure and is claimed separately; the employer grants the leave and submits the data. The two go together but are not dealt with by one document.

What happens if I enrol the child at a nursery?

The leave ends if the child is placed in an institution fully maintained by the state. The application contains a declaration to exactly that effect, and a change in circumstances has to be reported so that benefit is not received when it is not due.
