Common questions
- Can the employer refuse me paid leave?
- They can decline the particular dates, but not your right to leave. That is why the application is made in writing with a reference number: if it is refused, the refusal is of the period rather than of the leave, and you can propose other days.
- How far in advance is it filed?
- According to the employer's internal rules, and where there is a leave rota, in line with it. An application at the last minute is lawful but easily refused on the ground that nobody can cover the work, which is why the form has a field for who is standing in for you.
- Does unused leave expire?
- Unused days carry over, but the right to take them is not open-ended. If you have days accrued from earlier years, note that expressly in the application — that way there is a written trace that you asked to use them.
- Do I have to give a reason?
- No. For paid annual leave no reason is owed and the field can be left empty. A reason is given for leave that rests on a particular ground, such as unpaid leave and leave for marriage, blood donation or bereavement.
