Common questions

How far ahead is holiday requested in Spain?
The Spanish Workers' Statute sets no deadline for asking: the dates are agreed between employer and employee under the collective agreement and the company's holiday calendar, and the employee must know them at least two months before the holiday starts (art. 38). Asking in writing and in good time records the date of the request.
What can be done in Spain if the employer refuses the holiday dates or imposes others?
Bring a claim before the labour section of the Tribunal de Instancia in a fast-track procedure that needs no prior conciliation (arts. 64 and 125 of the Spanish Labour Procedure Act): within twenty working days of learning the dates set by the employer or, where no dates have been set, at least two months before the dates requested.
What happens in Spain to holiday that falls during sick leave?
If it falls during temporary incapacity due to pregnancy, childbirth or breastfeeding, or during birth leave, it is taken on other dates even after the calendar year has ended. If the sick leave has another cause and prevents taking the holiday in the year, it is taken after recovery, provided no more than eighteen months have passed since the end of the year in which it accrued (art. 38.3 of the Spanish Workers' Statute).

  • Notice of absence on sick leave to the employer (Spain)

A Spanish letter, in Spanish, for an employee on sick leave in Spain who wants to tell the employer in writing. Since 1 April 2023 (Spanish Royal Decree 1060/2022) the employee no longer hands in a copy of the sick note: the INSS, Spain's social security institute, sends its details to the employer electronically. The letter only reports the absence, its start date and, if wished, the estimated length, never the diagnosis. Hand it over against a signed receipt, send it by certified post or burofax, or use the channel set by the collective agreement. It holds health data, so it is sold blank and filled in by hand.

It is not a non-compete clause: it does not stop the employee working for another business later. Both sides sign it. In Spanish.
