Common questions

How many days of annual leave does an employee in Poland get?

20 days with under 10 years of service, and 26 days with at least 10 years (art. 154 of the Labour Code). Time in education counts towards service — a university degree counts as 8 years, for example. Part-time staff get a proportional amount, and in the year of a first job the leave builds up month by month.

What is leave on demand and how is it requested?

Up to 4 days a year out of the annual leave entitlement, which the employer must as a rule grant on the date the employee chooses (art. 167² of the Labour Code). It is requested on the day the leave starts at the latest — a phone call or an email is enough unless the workplace rules say otherwise. It does not add to the yearly entitlement.

Can the employer refuse leave on the dates requested?

Yes, when the employee's absence would disrupt normal work and there is a leave plan or the dates have to be agreed (art. 163 of the Labour Code). But the leave must be taken — outstanding leave has to be granted by 30 September of the following calendar year at the latest (art. 168 of the Labour Code).
