A Spanish letter, in Spanish, for an employee on sick leave in Spain who wants to tell the employer in writing. Since 1 April 2023 (Spanish Royal Decree 1060/2022) the employee no longer hands in a copy of the sick note: the INSS, Spain's social security institute, sends its details to the employer electronically. The letter only reports the absence, its start date and, if wished, the estimated length, never the diagnosis. Hand it over against a signed receipt, send it by certified post or burofax, or use the channel set by the collective agreement. It holds health data, so it is sold blank and filled in by hand.

Common questions
- In Spain, do I have to give my sick note to my employer?
- No. Since 1 April 2023 the doctor of the public health service or of the mutual insurer gives a single copy to the employee, and the INSS sends the note's administrative details to the employer electronically (Spanish Royal Decree 1060/2022). What you should still do is report the absence in the way the collective agreement or the company's rules require.
- Must I tell my Spanish employer what illness I have?
- No. The details of the sick note that reach the employer do not include the diagnosis, and this letter does not ask for it either. It is enough to say that you are on sick leave, from which date and, if you wish, the estimated length shown on the note. That is why the document is sold blank: it holds health data and is filled in by hand.
- How and when do I give the employer notice of my sick leave in Spain?
- As soon as possible, within the time and through the channel set by your collective agreement or the company (e-mail, an HR app). If you want proof, hand it over and ask for the «Recibí» on your copy to be signed, or send it by certified post with proof of receipt or by burofax with certified content.
