Common questions

How many days of paid leave are there in Spain for each reason?
Under art. 37.3 of the Spanish Workers' Statute: fifteen calendar days for marriage or registration as a civil partner; five days for a relative's or household member's accident, serious illness, hospital stay or surgery with home rest; two days for a death, plus two if travel is needed; one day for moving house. In addition, up to four days a year for urgent family reasons (art. 37.9). The collective agreement may improve them.
Are Spain's five days for a relative's hospital stay calendar or working days?
The labour chamber of the Spanish Supreme Court has held that they count as working days and need not start on the day of the event: they can be taken while the hospital stay or the need for care lasts. Give the first and last day of absence in the letter; if your collective agreement is more favourable, it applies.
What proof must be given to a Spanish employer for paid leave?
A document proving the event and, where it matters, the relationship: the marriage or partnership registration certificate, a hospital admission or surgery note, the death certificate or the new registration on the municipal roll. Diagnoses and health details beyond what is essential are not needed; the collective agreement may specify how urgent family reasons are proved.

  • Notice of absence on sick leave to the employer (Spain)

A Spanish letter, in Spanish, for an employee on sick leave in Spain who wants to tell the employer in writing. Since 1 April 2023 (Spanish Royal Decree 1060/2022) the employee no longer hands in a copy of the sick note: the INSS, Spain's social security institute, sends its details to the employer electronically. The letter only reports the absence, its start date and, if wished, the estimated length, never the diagnosis. Hand it over against a signed receipt, send it by certified post or burofax, or use the channel set by the collective agreement. It holds health data, so it is sold blank and filled in by hand.

It is not a non-compete clause: it does not stop the employee working for another business later. Both sides sign it. In Spanish.
