Common questions
- How much notice is needed for parental leave in Italy?
- As the collective agreement provides and in any case at least five days, two if the leave is by the hour, stating when the period starts and ends (art. 32(3) of Italian Legislative Decree 151/2001), unless this is objectively impossible. Notice to the employer is not enough for the allowance: the application goes to INPS online with SPID, CIE or CNS, or free of charge through a patronato. Since 1 January 2026 employees can use the leave until the child turns fourteen.
- How does compulsory paternity leave work in Italy?
- An employed father has ten working days, twenty for a multiple birth, which may be split, between two months before the expected birth and five months after it, paid at 100% (art. 27-bis of Italian Legislative Decree 151/2001). He gives the employer written notice at least five days ahead; in the private sector the allowance is advanced in the pay packet. Since 2025 it also applies to the intended mother in a couple of two women (Constitutional Court ruling no. 115/2025).
- Can parental leave be taken by the hour in Italy?
- Yes. Parental leave can be taken by the day or by the hour, as the collective agreement provides or, if it says nothing, for half the average daily working time (art. 32(1-bis) of Italian Legislative Decree 151/2001). For hourly leave the minimum notice to the employer is two days. The application to INPS states the form chosen.

It is for cases where the collective agreement or the company asks for written notice and offers no portal of its own. Send it by PEC to the company’s certified address, by registered post with proof of receipt, or by hand. It holds health data, so it is sold blank and filled in by hand.
