Is an employee in Romania entitled to unpaid leave?
Yes, to deal with personal matters (art. 153 of the Labour Code). Its length is set by the applicable collective agreement or the internal rules, and it is granted with the employer's agreement, which suspends the employment contract for that time (art. 54).
What happens to pay and contributions during unpaid leave?
The contract is suspended, so the employee gets no salary and no social contributions are paid for that time, which affects the contribution record for the pension. For a long leave, it is worth checking in advance how health insurance cover will continue.
How far ahead should an unpaid leave request be made?
The Labour Code sets no deadline; the collective agreement or internal rules may. The request should go in early enough for the employer to arrange cover, and the employee keeps a copy with its registration number.
