The written demand by which an employee or former employee asks an employer in Moldova for wages and other sums not paid on time, month by month, by a set date. It cites the extra 0.3% a day the Moldovan Labour Code adds when the delay is the employer's fault (art. 330) and the three years a court claim has (art. 355). It is handed in for registration or sent by registered post with acknowledgement of receipt, and proves that payment was asked for before a petition to the State Labour Inspectorate.

Common questions
- What can an employee in Moldova do when the employer does not pay wages?
- First ask in writing, with this demand, so that the date can be proved. You can then petition the State Labour Inspectorate free of charge, including online at lucrezlegal.md. The inspectorate checks the employer and can record the breach, but it cannot make it pay at once: if the employer still does not pay after the check, the money is claimed in court, where the inspection records serve as evidence.
- How long does a Moldovan employee have to claim unpaid wages in court?
- Three years from the day the right to payment arose, for wages and other sums owed to the employee (art. 355 of the Moldovan Labour Code); for other breaches it is three months from when you learned of them. For wages the employer calculated but did not pay, the district court can issue a court order (ordonanță judecătorească) in a simplified procedure (art. 345 of the Code of Civil Procedure); other claims go to an ordinary action. When the delay is the employer's fault, the Labour Code adds 0.3% of the unpaid sum a day (art. 330(2)).
- How should the wages demand be sent so that it can be proved?
- Hand two copies to the employer and ask for the registration number and date to be written on yours; if it is not registered, send it through Poșta Moldovei by registered letter with acknowledgement of receipt. The demand is signed by hand; sent by e-mail, it can carry a qualified electronic signature (MSign or a mobile signature). Keep the registered copy or the acknowledgement of receipt: it goes with a petition to the inspectorate or a court claim.

The letter can also propose ending earlier by written agreement. It is handed in for registration or sent by registered post with acknowledgement of receipt.

It is handed to the employer for registration.
