Common questions
- How does ending a job by agreement differ from resigning in Moldova?
- Resignation is the employee's decision alone: a written request and 14 calendar days' notice, or one month for managers and the chief accountant (art. 85 of the Moldovan Labour Code). An agreement can be made at any time, without notice, for the date agreed, and both parties sign it (art. 82¹). The ground is written in the termination order, so check that the order cites the one chosen.
- When must a Moldovan employee be paid when a job ends by agreement?
- The agreement fixes payment on the day of release: pay for the days worked, compensation for untaken annual leave and any other sum agreed; the Moldovan Labour Code requires the employer to pay every sum due when the contract ends (art. 143). For a delay that is the employer's fault, the code adds 0.3% of the unpaid sum for each day (art. 330(2)). The agreement writes the sum in words and the date of payment, so neither can be disputed.
- Can an employer in Moldova force an employee to sign a termination agreement?
- No. The agreement exists only if both parties sign it; without your signature the contract continues, and the employer can dismiss only on the grounds and by the procedure of the Labour Code. If you consider the ending was forced on you, you can challenge it in court within three months of being shown the termination order or otherwise learning of the breach (art. 355 of the Moldovan Labour Code).
