For an employer and an employee in Malta who both want the job to end on an agreed date, on an indefinite or a fixed-term contract: an agreement that sets the last day, the final wages, the unused leave and the proportionate statutory bonuses due by the next pay day, any further sum agreed, the FS3 and the Jobsplus form, and the return of property, and that leaves the Industrial Tribunal's four months untouched. Both sign two copies.

Common questions

Why end a job in Malta by mutual agreement instead of a resignation?
It lets both sides fix the last day without the notice article 36(5) of Cap. 452 requires, and it matters most on a fixed-term contract: there, whoever ends the contract early without good and sufficient cause owes the other half the wages for the rest of the term (article 36(11)–(12)), while an agreed end owes neither side anything for the early end.
What must still be paid when employment in Malta ends by agreement?
The wages up to the last day, the leave not taken and the proportionate share of the statutory bonuses and income supplement, all by the next pay day (articles 22(2) and 23 of Cap. 452). Any further sum is what the parties agree; write the gross amount in the agreement so that both know what the FS3 will show.
Does signing this agreement stop me going to the Industrial Tribunal in Malta?
No. The agreement says so in terms: a worker who believes a right was breached, for example that the agreement hid a dismissal, may still refer the complaint to the Industrial Tribunal, no later than four months from the effective date of the alleged breach (article 75(3) of Cap. 452).

Related documents

  • Request for an employer's reference (Malta)

For an employee or former employee in Malta who needs a written reference or certificate of service for a new job, a rental or a permit: a polite letter asking the employer to confirm your dates of employment and job title, or also your duties and its view of your work, and where to send it. For proof of dates alone, your Jobsplus employment history is free. Send it by email and keep a copy.

  • Contract of service for an indefinite time (Malta)

For an employer and an employee in Malta agreeing a permanent job: a written contract of service under the Employment and Industrial Relations Act (Cap. 452) setting the start, the probationary period, the job and place of work, hours, wages paid at most four weeks in arrears, statutory bonuses, leave, and notice by length of service as article 36 requires. Both sign two copies and each keeps one.

  • Resignation letter (Malta)

For an employee in Malta on a contract for an indefinite time, or still on probation, who is leaving the job: a letter that resigns, states the notice you give and your last day, counted as the Employment and Industrial Relations Act (Cap. 452) requires, and asks for written confirmation, your final wages and unused leave by the next pay day, your share of the statutory bonuses and your FS3. Send it by registered letter with a copy by email, and keep the post office receipt.

  • Annual leave request (Malta)

For an employee in Malta who wants to book paid annual leave: a dated written request to the employer giving the first and last day and the length of the leave, under the Organisation of Working Time Regulations (S.L. 452.87) and your contract, and asking for written approval or other dates. It leaves a record if the leave is later disputed or not paid. Send it by email and keep a copy.

  • Letter to an employer about unpaid wages (Malta)

For an employee or former employee in Malta whose wages, leave pay or statutory bonuses have not been paid: a letter to the employer that lists what is owed, month by month, cites the Employment and Industrial Relations Act (Cap. 452) on when wages are due, and sets a date for payment before a free complaint to the Department for Industrial and Employment Relations (DIER). Send it by registered letter with a copy by email, and keep the post office receipt.

  • Settlement agreement (Malta)

For two parties in Malta — individuals or businesses — who settle a money dispute out of court: unpaid work, damage, a deposit, a debt in dispute. The agreement records the dispute, the sum agreed and when it is paid, and that both give up the rest of their claims about it once it is paid. The Civil Code requires a compromise to be in writing (article 1233). It is for disputes not yet before a court or tribunal. Both sign it and each keeps an original.
