Common questions

How much notice must I give when I resign from a job in Malta?
On a contract for an indefinite time, article 36(5) of Cap. 452 sets it by your service with the employer: one week after more than one month and up to six months, two weeks up to two years, four weeks up to four years, eight weeks up to seven years, then one week more for each further year, up to twelve weeks. A technical, administrative, executive or managerial post may have a longer notice agreed in the contract. On probation it is one week once you have worked more than a month.
What happens if I leave without working my notice in Malta?
Under article 36(10) of Cap. 452, an employee who does not give the notice owes the employer half the wages for the notice period, unless there is good and sufficient cause for leaving (article 36(14)). The employer may instead let you go before the notice ends by paying the wages for the rest of it (article 36(9)). If you want to leave earlier, agree the date with your employer in writing.
Can I use this letter to leave a fixed-term contract in Malta early?
No. This letter is for a contract for an indefinite time and for probation. Leaving a fixed-term contract before its end, without good and sufficient cause, makes you liable to pay the employer half the full wages for the rest of the term (article 36(12) of Cap. 452). The way out is to agree an earlier end with the employer in writing, which the agreement ending employment by mutual consent sets down.
When must my last wages and unused leave be paid after I resign in Malta?
By the next pay day after the employment ends, as if it had not ended (article 22(2) of Cap. 452), with your proportionate share of the statutory bonuses and income supplement (article 23). If they are not paid, the Department for Industrial and Employment Relations (DIER) takes complaints free of charge, and the letter about unpaid wages asks the employer first.

For an employee or former employee in Malta who needs a written reference or certificate of service for a new job, a rental or a permit: a polite letter asking the employer to confirm your dates of employment and job title, or also your duties and its view of your work, and where to send it. For proof of dates alone, your Jobsplus employment history is free. Send it by email and keep a copy.

  • Letter to an employer about unpaid wages (Malta)

For an employee or former employee in Malta whose wages, leave pay or statutory bonuses have not been paid: a letter to the employer that lists what is owed, month by month, cites the Employment and Industrial Relations Act (Cap. 452) on when wages are due, and sets a date for payment before a free complaint to the Department for Industrial and Employment Relations (DIER). Send it by registered letter with a copy by email, and keep the post office receipt.

  • Annual leave request (Malta)

For an employee in Malta who wants to book paid annual leave: a dated written request to the employer giving the first and last day and the length of the leave, under the Organisation of Working Time Regulations (S.L. 452.87) and your contract, and asking for written approval or other dates. It leaves a record if the leave is later disputed or not paid. Send it by email and keep a copy.

  • Agreement ending employment by mutual consent (Malta)

For an employer and an employee in Malta who both want the job to end on an agreed date, on an indefinite or a fixed-term contract: an agreement that sets the last day, the final wages, the unused leave and the proportionate statutory bonuses due by the next pay day, any further sum agreed, the FS3 and the Jobsplus form, and the return of property, and that leaves the Industrial Tribunal's four months untouched. Both sign two copies.

  • Contract of service for an indefinite time (Malta)

For an employer and an employee in Malta agreeing a permanent job: a written contract of service under the Employment and Industrial Relations Act (Cap. 452) setting the start, the probationary period, the job and place of work, hours, wages paid at most four weeks in arrears, statutory bonuses, leave, and notice by length of service as article 36 requires. Both sign two copies and each keeps one.

  • Landlord's notice ending a lease at the end of its term (Malta)

For a landlord in Malta who does not want a long private residential lease to renew. The notice tells the tenant that the lease ends on the last day of its current term, and states the tenant's protections: it must be sent by registered letter at least three months before that day, or the lease renews by law for a year; it cannot end the lease earlier; and it is not an eviction. Not for short leases. Send it by registered letter in time and keep the post office receipt.
