The notice by which an employee in Romania resigns. Does a Romanian employer have to approve a resignation?

No. A resignation is the employee's unilateral act and needs no reason; the employer must only register it. If it refuses, the employee may prove the resignation by any means of evidence (art. 81 of the Labour Code) — which is why it is best sent by registered post or handed in with a registration number written on the employee's own copy.

How much notice does a resignation in Romania need?

What the contract sets, but at most 20 working days for staff roles and at most 45 for management (art. 81). The contract ends when the notice runs out, or earlier if the employer waives it. The employee may resign without notice if the employer does not meet its obligations under the contract — by not paying the salary, for example.

What is paid out when an employee resigns?

Pay for the days worked, payment in money for untaken annual leave — the only case in which leave is paid instead of taken (art. 146) — and, on request, the document certifying the work, seniority and salary (art. 34). Resigning does not, as a rule, give a right to unemployment benefit.
