Common questions
- What notice period applies to employees in Liechtenstein?
- After probation, unless agreed otherwise, one month in the first year of service, two months in the second to ninth and three months from the tenth, each to the end of a month (§ 1173a Art. 45c ABGB). A contract or a standard or collective agreement may set other periods in writing, but below one month only a collective agreement in the first year. During probation, the first month, notice is seven days to the end of a working week (Art. 45b) — unlike Switzerland, where it can end on any day.
- Does Liechtenstein law apply if I live in Switzerland or Austria?
- For a job in Liechtenstein, Liechtenstein employment law generally applies, cross-border commuters included; your contract and any collective agreement (GAV) of your branch govern the details. The rules on notice come from Swiss law and sit in § 1173a ABGB, with periods largely like Switzerland's. Check whether your contract or GAV requires written notice; the statute itself sets no form.
- By when must my resignation reach the employer in Liechtenstein?
- Before the notice period starts: with one month's notice to the end of May, it must reach the employer by the end of April. When a registered letter that is not collected at once counts as received is not settled for Liechtenstein, so post it at least ten days before the last day, or hand it over and have receipt confirmed on your copy.
