Common questions
- Which reference can I ask for in Liechtenstein?
- At any time, a reference on the kind and length of the employment and on your performance and conduct — also as an interim reference while you are still employed (§ 1173a Art. 36 para. 1 ABGB). At your express request it is limited to kind and length (Art. 36 para. 2). The rule comes from Swiss law; collective agreements call it the Arbeitszeugnis.
- What can I do in Liechtenstein about an incorrect reference?
- Ask for the correction in writing, with the current and the requested wording and supporting evidence. If the employer does not agree, you can sue for the correction at the Princely Court of Justice (Landgericht) in Vaduz; no conciliation step is required, though a voluntary settlement hearing at court is possible (§ 227 ZPO). Members of an employees' organisation often get support from it.
- How soon must a Liechtenstein employer issue the reference?
- The law sets no period: the reference is owed as soon as you ask for it. The letter therefore sets a date by which you expect it signed; two to three weeks is a usual frame. If it does not come, send a short reminder with a final date before going to court.
