Resignation, references, family leave and pay in Liechtenstein
Employment law in Liechtenstein sits in § 1173a ABGB and comes from Swiss law, but its details differ: in probation notice is seven days to the end of a working week, and afterwards one, two or three months to the end of a month, depending on years of service (Art. 45b, 45c). For a job in Liechtenstein it generally applies to cross-border commuters too. The resignation letter and its German version settle holiday, final pay and the reference, which you may ask for at any time with the reference request (Art. 36).
Family leave is far longer than in Switzerland: 20 weeks' maternity leave, two weeks' paternity leave and four months' parental leave per parent after six months' employment, to be announced three months ahead where possible (Art. 34a–34f); see the notice of family leave. A dismissal for taking such leave is abusive.
To claim compensation for an abusive dismissal, object in writing before the notice period ends, with the objection to an abusive dismissal, and sue within 180 days after the employment ends, or the claim lapses (Art. 48). Unpaid wages are claimed with the wage demand; if they stay unpaid, the Landgericht in Vaduz issues a conditional payment order on application. Wage claims are time-barred after five years. Courts work in German only.
