Resignation and employment references in Switzerland
Swiss law sets no form for resigning, but contracts and collective agreements often require writing, and you must prove that the notice arrived in time. After probation the period is one month in the first year of service, two months up to the ninth and three months after that, each to the end of a month (Art. 335c CO); during probation it is seven days unless agreed otherwise in writing (Art. 335b CO). The resignation letter in German, French and English gives notice to the date you choose, falls back to the next possible date, and asks for confirmation, the final pay and the salary certificate.
A reference (Arbeitszeugnis) can be requested at any time, also as an interim reference while you are still employed; on request it is limited to a confirmation of the kind and length of the job (Art. 330a CO). The reference request in German and the reference request in English also ask for corrections, with the current and the requested wording and a deadline.
If an employer refuses, the claim goes first to the conciliation authority at the employer's seat or your usual place of work (Art. 34 CPC), and employment disputes up to CHF 30'000.00 carry no court costs. Register with the regional employment centre (RAV) at job-room.ch as soon as you know you will be out of work.
