Common questions
- In French-speaking Switzerland, does an agreement to end employment hold if I give up rights in it?
- Ending by mutual agreement is possible at any time, without notice and without a set form (Art. 115 CO); writing serves as proof. The agreement removes the protection against dismissal, including the protected periods for illness, accident or pregnancy (Art. 336 ff., 336c CO). During the employment and the month after it, the employee also cannot waive claims under mandatory law (Art. 341 para. 1 CO). Where such rights or that protection are waived, the Federal Supreme Court upholds the agreement only if both sides make concessions of comparable value (4A_13/2018): clause 4 records them.
- What does an agreement to end employment mean for the RAV/ORP and the unemployment fund?
- The unemployment fund examines whether you are unemployed through your own fault or gave up pay at the insurance's expense, and then suspends your entitlement for a number of days, at most 60 per ground (Art. 30 LACI), particularly if you accept an end date earlier than the ordinary notice period would give. For days still covered by pay owed to you, it pays nothing (Art. 11 para. 3 LACI). The agreement states at whose wish it was made; the fund alone draws the consequences. Register with the regional employment office (ORP) as early as possible, at the latest on your first day without work, online at job-room.ch.
- What is in the agreement, and who signs it for a company?
- The end date, work or release until then, pay with holiday and overtime, any severance payment, the concessions on both sides, the reference, the return of property, the non-compete and what the agreement settles. Nothing obliges you to sign on the spot: take time to reread it. For a company, the person authorised to represent it signs (commercial register); each party signs two copies, by hand or with a qualified electronic signature.
