Common questions

Can a Swiss job be ended by agreement, and what does the employee give up by signing?
Yes, at any time, without notice and without a set form (Art. 115 CO); writing serves as proof. The agreement removes the protection against dismissal, including the protected periods for illness, accident or pregnancy (Art. 336 ff., 336c CO). During the employment and the month after it, the employee also cannot waive claims under mandatory law (Art. 341 para. 1 CO). Where such rights or that protection are given up, the Federal Supreme Court upholds the agreement only if both sides make concessions of comparable value (4A_13/2018); clause 4 records them. Nothing obliges anyone to sign on the spot.
How does a mutual termination agreement affect unemployment benefit in Switzerland?
The unemployment fund examines whether you are unemployed through your own fault or gave up pay at the insurance's expense, and if so suspends your entitlement for a number of days, at most 60 per ground (Art. 30 AVIG), particularly if you accept an end date earlier than ordinary notice would give. For days still covered by pay owed to you, it pays nothing (Art. 11 para. 3 AVIG). The agreement states at whose wish it was made; the fund alone draws the consequences. Register with the regional employment office (RAV, ORP or URC) as early as possible, at the latest on your first day without work, online at job-room.ch.
Is an agreement to end employment written in English valid in Switzerland, and who signs it?
Yes, between employer and employee any language both understand will do, though a version in the language of the employment contract avoids argument later. For a company, the person authorised to represent it signs (as shown in the commercial register); each party signs two copies, by hand or with a qualified electronic signature. No forum clause is included, because an employee cannot waive the statutory forum in advance (Art. 35 para. 1 let. d CPC). Swiss authorities and courts work in their official language — German, French or Italian — so this English version is for dealings between private parties.
