The agreement by which a Romanian employer and employee end the employment contract on an agreed date, without notice or a reason (art. 55(b) of the Labour Code). It fixes the last working day, the final pay — including payment for untaken leave — and the return of company property, and leaves room for any extra sum negotiated. It cannot contain the employee waiving statutory rights.

- What does ending a Romanian employment contract by agreement mean?
- The contract ends on the date the employer and employee agree, with no notice and no need for a reason (art. 55(b) of the Labour Code). Both sides must agree freely; the employee cannot be forced to sign, and a signature given under pressure can be challenged in court.
- Is there unemployment benefit after ending a contract by agreement?
- As a rule, no. Law no. 76/2002 grants unemployment benefit to those whose contract ended for reasons not attributable to them, and ending it by agreement, like resigning, does not usually fall into that category. If the benefit matters, it is worth checking with the employment agency before signing.
- Can the employee give up rights in the agreement?
- No. Employees cannot waive rights granted by law, and any settlement aimed at that is void (art. 38 of the Labour Code). The agreement can set the end date and extra sums, but the salary owed and payment for untaken leave are due regardless.
