Does ending a Greek employment contract by mutual consent need a reason or compensation?
No. No statute governs mutual termination as such: a clear shared will of employer and employee is enough, with no required form, reason or compensation. The parties may agree a lump sum, while pay earned, compensation for untaken leave and the pro rata bonuses are owed in any case. The written agreement proves that the ending was mutual and not a dismissal.
How is a mutual termination declared in ERGANI II, and how can it be signed at a distance?
The employer declares the end of the employment in ERGANI II, and the signed agreement is the proof that it was a joint decision. If the parties do not meet, they can sign it free of charge through the digital certification of a private agreement on docs.gov.gr, which has the force of a signature authenticated by a public office.
Is DYPA unemployment benefit paid after ending a Greek contract by mutual consent?
The regular unemployment benefit of DYPA, the Greek public employment service, is as a rule linked to dismissal or the expiry of a fixed-term contract, not to a departure the employee chose or accepted. A mutual termination may therefore give no right to it. If the benefit matters, check the conditions with DYPA before signing.
