Common questions

How does a mutual termination differ from giving notice?

Notice is one-sided and runs for the notice period; a mutual agreement needs both sides but can end the job on any agreed day, including at once. Special protection against dismissal — during pregnancy or in the years before retirement, for example — does not apply to an agreement, so the employee should sign it knowingly.

Why does the agreement record who proposed the termination?

Because the consequences depend on it. Where the employer proposes it for reasons not concerning the employee, at a firm with at least 20 staff, severance pay is due. Who proposed it also goes on the certificate of employment, and the labour office takes it into account when deciding on unemployment benefit.

Can a mutual termination agreement be withdrawn?

As a rule, no, because it rests on the will of both sides. It can be changed only by another agreement, or set aside for mistake, threat or deceit (arts. 84–87 of the Civil Code with art. 300 of the Labour Code), which has to be proved. So read it calmly before signing, and do not sign it under time pressure.
