Common questions
- What separates a full, an interim and a simple confirmation of employment in Ticino?
- A full reference states the kind and length of the employment and assesses your performance and conduct (Art. 330a para. 1 CO); an interim one has the same content but is issued while you are still employed, for instance before a change of manager. Only if you expressly ask does the employer instead issue a confirmation limited to the kind and length of the job (para. 2), without any assessment. You can ask at any time; the letter lets you choose.
- Where can I turn in Ticino if the employer will not correct the reference?
- Ask for the correction in writing, with the current wording, the wording wanted and supporting documents such as appraisal interviews: case law requires a reference to be true, complete and worded with goodwill. If the employer refuses, you can file a conciliation request at the employer's seat or where you usually work (Art. 34 CPC). In Ticino the justice of the peace (giudice di pace) conciliates disputes up to CHF 5'000.00, above that the district court's registrar (segretario assessore della Pretura) (art. 2 and 3 of the cantonal act applying the CPC). Up to CHF 30'000.00 there are no court costs (Art. 113 and 114 CPC).
- Is there a deadline for a Swiss employer to hand over the reference I asked for?
- The law sets none: the reference is owed as soon as you ask and, when you leave, for the end of the employment. The letter therefore sets a date by which you expect it signed; two to three weeks is usual. If it does not come, send a short reminder with a final date before turning to the conciliation authority.
