For employees in Switzerland who have been dismissed with notice or summarily, in German: the written request that the employer give the reasons for the dismissal in writing (Art. 335 para. 2 CO, or Art. 337 para. 1 CO for a summary dismissal), with a deadline for the answer. The request does not accept the dismissal and reserves the objection for abuse, which must reach the employer before the notice period ends. Print, sign and send by registered post.

Common questions

Does my employer in Switzerland have to give reasons for dismissing me?
Yes, if you ask: the party giving notice must state the reasons in writing when the other party requests it (Art. 335 para. 2 CO), and the same applies to a summary dismissal (Art. 337 para. 1 CO). The law sets no deadline or form for the request; in writing and by registered post you have proof of it. Missing reasons do not make the dismissal invalid, but the reasons show whether it may be abusive.
Can I wait for the reasons before objecting to the dismissal?
No. If you consider the dismissal abusive (Art. 336 CO), your written objection must reach the employer by the end of the notice period (Art. 336b para. 1 CO), even if the reasons are still missing or come late. Without it, the compensation of up to six months' wages is lost. After that you have 180 days from the end of the employment to bring the claim. The two letters can also be sent at the same time.
What else are the written reasons useful for?
For unemployment insurance: the unemployment fund asks why the job ended in order to check whether you are unemployed through your own fault (Art. 30 AVIG), and the employer's reasons are then on paper. They also help you check a reference and discuss continuing or an agreement to end the employment.
