Renting a flat in Switzerland: notice, deposit, rent and defects
Swiss tenancy law is federal, but the cantons run the conciliation authorities and approve the forms a landlord must use to give notice or raise the rent; a landlord's notice on any other paper is void. A tenant needs no official form: notice in simple writing, three months ahead to the date in the lease or a local termination date, signed by every tenant and, for a family home, with the spouse's or registered partner's express consent. The tenant's notice has a line for each, and comes in French, in Italian and, for leases in English, in English. To leave earlier, propose a replacement tenant who is solvent and willing to take over the lease on the same terms; the rent runs until that person could take over.
The rent follows the mortgage reference rate, 1.25% since 2 September 2025, which the Federal Housing Office publishes next on 1 December 2026. If your rent rests on a higher rate, ask for a reduction for the next termination date; the tenants' association offers a free calculator at mieterverband.ch/senkung. For mould, a broken heating or noise, a notice of defects sets a deadline and asks for a lower rent. Simply paying less risks notice for arrears. Rent deposited on time with the office the canton designates, after a written deadline and warning, counts as paid, but the tenant must then take the claims to the conciliation authority within 30 days.
The deposit is held by a bank in an account in your name and is at most three months' rent. After moving out, ask for its release from the landlord, or from the bank alone once a year has passed without the landlord bringing debt enforcement or a court action against you. If the landlord refuses a reduction or does not answer within 30 days, you have 30 more days to apply to the conciliation authority, which charges no court fees. DocMuse is a private service, neither an authority nor a law firm, and gives no legal advice.

It names the bank, the account, the amount, your IBAN and a reply date. Print, sign and send it registered.
