For tenants in Switzerland whose rent is based on a reference interest rate above today's: the written request asking the landlord to lower the rent under Art. 270a of the Code of Obligations (CO), from the next termination date. It sets out the rate behind your rent, the current rate, the cut you ask for and the landlord's 30 days to answer, and names your canton's conciliation authority if they refuse. Check your claim first with the free calculator of the Swiss tenants' association (ASI in Ticino). Every tenant signs it, and it goes by registered post. In Italian.

Common questions

Does today's reference rate entitle a Swiss tenant to pay less rent?
It does if your rent was set on a higher reference rate than the current one, as stated in the lease or the last rent change. The rate has stood at 1.25% since 2 September 2025 and the Federal Housing Office publishes it quarterly, next on 1 December 2026. A fall of 0.25 points gives a right to a 2.91% reduction, a fall of 0.50 points 5.66% (Art. 13 para. 1 OLAL). The landlord can deduct 40% of inflation (Art. 16 OLAL) and cost rises since the last adjustment. Check with the free calculator of the Swiss tenants' association in Ticino (ASI) at asi-infoalloggio.ch. Indexed and stepped rents do not follow the reference rate.
When does a reduced rent start once a Swiss landlord has been asked?
On the next termination date (Art. 270a para. 1 CO). So the request has to reach the landlord before the notice period begins, exactly as a notice would: for the end of March with three months' notice, by the end of December. A request that arrives later moves the reduction to the date after. All tenants sign it, and it is posted registered to the landlord or the agency.
What if a Swiss landlord rejects the reduction request or stays silent?
The landlord has 30 days to answer. After a full or partial refusal, you can apply to the tenancy conciliation authority within 30 days of the answer; if there is none, within 30 days after the landlord's period ends (Art. 270a para. 2 CO). In Ticino it is the conciliation office for the municipality where the flat is. You can apply in writing or orally (Art. 202 para. 1 CPC), and conciliation carries no court costs (Art. 113 para. 2 let. c CPC). Until an agreement or a decision, keep paying the current rent.
