Common questions
- When must a Swiss bank pay a rent deposit back to the tenant?
- When both sides consent, or on a final payment order (one not opposed, or whose opposition has been lifted) or a final court judgment (Art. 257e para. 3 CO). So after the handover, ask the landlord for consent first. If a year passes after the lease ends without the landlord pursuing a claim against you through debt enforcement or a court action (an application to the conciliation authority is enough for that), the bank must pay you on your request alone — the letter's second option is written for that.
- What should go with the request to the bank once a year has passed since moving out?
- This letter with the bank option chosen, a copy of the lease or of the deposit receipt, and something showing when the lease ended — the notice, the landlord's confirmation or the handover record. Check whether the bank has its own form. If within the year the landlord started debt enforcement or a court action against you, even only by applying to the conciliation authority, the bank will not pay out on your request alone.
- What does Ticino's own law add on rent deposits?
- Ticino's act of 24 June 2010 applying the federal tenancy rules adds to Art. 257e CO: the landlord must place a cash deposit within 10 days in a savings or deposit book in the tenant's name at a bank with its seat or a branch in Ticino, capped at three months' rent (art. 6); the bank issues a receipt in two copies, one per party (art. 7); the money comes out only as Art. 257e para. 3 CO allows, though the tenant may draw the interest on their own signature (art. 8). A lease cannot override this to the tenant's detriment (art. 10).
