- On those the lease sets, usually unpaid rent, electricity, water or common charges left unpaid, and damage beyond ordinary wear. The landlord cannot keep it for wear from normal use or for repairs that are the landlord's own responsibility. Each deduction should be justifiable, ideally by the move-out record and by bills or quotes for the repairs.
- What can a tenant in Cyprus do if the landlord does not return the deposit?
- First send this written demand by registered post, with the documents attached, giving a deadline to pay and to reply in writing, as the Civil Procedure Rules require before a claim for a sum of money; a party who ignores them can be penalised in costs. If the landlord does not pay, the tenant can claim the amount in the District Court, often through a lawyer who first sends a letter of their own. The move-in record, the move-out record, the rent receipts and photographs are the evidence that counts.
- Can interest be claimed on a deposit returned late in Cyprus?
- If the amount is claimed in court, the court can also award legal interest, which is why the demand mentions interest and costs. While the tenancy lasts, the deposit earns no interest unless the lease says otherwise. In practice a clear demand with a deadline settles most cases before interest becomes an issue.
