The letter in which a former tenant in Romania demands back a deposit the landlord has not returned. It is written as a summons under art. 1015 of the Code of Civil Procedure — with 15 days to pay — so that, sent by registered post with declared contents and acknowledgment of receipt, it opens the way to a payment order if the money is not returned.

- Why is the deposit letter written as a summons?
- Because it also meets the condition set before a payment order. The Romanian Code of Civil Procedure requires the debtor to be summoned to pay within 15 days, through a bailiff or by registered post with declared contents and acknowledgment of receipt (art. 1015), and proof of the summons is attached to the application.
- How must the summons be sent to count?
- By registered post with declared contents and acknowledgment of receipt, from the post office, or through a bailiff. An ordinary letter or an email is not enough for a payment order. Keep the copy stamped by the post office and the acknowledgment of receipt.
- What comes next if the landlord still does not pay?
- After the 15 days, an application for a payment order can be filed at the local court, with the rental agreement, the move-out record and proof of the summons. The procedure is simplified and quick, with the parties summoned to a hearing at short notice, and the payment order it produces is enforceable.
