Fixed-term home rental agreement (Romania)

A Romanian residential tenancy between private individuals for a set period: rent and payment day, deposit, utilities, each side's obligations and a handover record when the home is handed over and returned. Does a Romanian rental agreement have to be registered with ANAF?

Yes. A landlord who is a private individual registers the agreement with the competent tax office within 30 days of signing, on form C168. Registration also pays off directly: a registered agreement is an enforcement title for the rent (art. 1798 of the Civil Code), so unpaid rent can be enforced without going to court first.

Can a tenant in Romania leave before a fixed-term agreement runs out?

Yes. The Civil Code lets the tenant of a home end a fixed-term agreement with at least 60 days' notice, and a clause setting a shorter period has no effect (art. 1825). The landlord may end it early only if the agreement gives that right — here, only for the housing needs of the landlord or the family — and also with 60 days' notice.

What deposit can a Romanian landlord ask for, and when is it returned?

The law sets neither the amount nor the deadline for returning it — the agreement does. This one returns it within 30 days of the home being handed back, keeping only unpaid rent and charges and damage beyond ordinary wear. The handover records made at move-in and move-out show what was damaged during the tenancy.
