Common questions
- Does a flat rental in Moldova have to be agreed in writing?
- Yes. The Moldovan Civil Code requires writing for a lease of an immovable (art. 1252), and the term may not exceed 99 years (art. 1253). Sign two originals, one for each side, and attach the handover record. If the term is longer than three years, the lease binds a new owner only if it was noted in the real-estate register (art. 1276).
- Can a tenant in Moldova leave before a fixed-term lease ends?
- The Civil Code gives the tenant no general right to leave before the term ends: the lease or a written agreement can (arts 1279(c) and 1283(2)). That is why this lease lets you choose an early exit with one or three months' notice, or none. Without notice, the tenant may leave if the home is a real danger to health (art. 1281(3)), and may also end the lease in the cases of art. 1283 or if the landlord fails to perform, on the terms of arts 915–917.
- What happens in Moldova if the tenant stays on after a fixed term ends?
- If the parties carry on tacitly — the tenant lives there and pays and the landlord accepts the rent — the lease is treated as extended for an indefinite term (art. 1280(1) of the Civil Code). From then on either side may end it with three months' notice (art. 1281). To avoid the extension, send written notice before the end that you will not continue.
- How much deposit may a landlord in Moldova ask for, and when is it repaid?
- The Moldovan Civil Code sets neither the amount of a deposit nor when it is repaid: the lease does. This one repays it within 30 days of the home being handed back, keeping only unpaid rent and charges and damage beyond normal wear, for which the tenant does not answer (art. 1265).
