Common questions

Does a lease in Cyprus still have to be stamped?
No. Stamp duty was abolished from 1 January 2026 by Law 239(I)/2025. Until then a lease had to be stamped within 30 days of signing, and many guides and templates online still say so. A lease signed today needs no stamp. What the law does require of a lease for more than a year is that the parties sign it at the end in front of two witnesses, who sign too (Contract Law, Cap. 149, s. 77); otherwise it does not hold for the agreed term. This lease has room for the witnesses.
When does a tenant in Cyprus become a statutory tenant?
When the tenancy ends and the tenant stays on, if the home is in a controlled area and was completed by 31 December 1999. The Rent Control Law of 1983 then applies: the rent rises only once every two years, up to the percentage a decree caps unless it is below 90% of the average for the area, and the landlord recovers possession only on a ground the Law allows, by order of the Rent Control Court. Newer homes and homes outside the controlled areas are governed by the lease alone, and the lease records which of the two applies.
Can the tenant leave a fixed-term lease in Cyprus early?
Only if the lease allows it. Cypriot law gives a tenant no right to leave early, and one who leaves without such a clause risks owing the rent to the end of the term. That is why this lease has the break clause Cypriot leases call a diplomatic clause: after the number of months you agree, often six, the tenant ends the lease by written notice, usually of one or two months, paying any compensation agreed.
