- Can a tenant in Cyprus sublet without the landlord's consent?
- Not where the lease forbids it, as DocMuse's Cypriot leases do without prior written consent. Subletting against the lease breaches it, which can lead to the tenancy being ended. In a statutory tenancy the Rent Control Law (art. 11) makes it a ground for the landlord to seek recovery of possession, and subletting at a profit unreasonably disproportionate to the rent is another. That is why this request asks for consent before subletting and keeps written proof of it.
- Does short-term letting through a platform in Cyprus need anything more?
- Yes. Besides the landlord's consent, a home let short-term to visitors must be entered in the Deputy Ministry of Tourism's Register of Self-Catering Accommodation before it is advertised, and its registration number must appear in every listing (Law 34(I)/2019). A tenant who lets it registers it as the operator, with the owner's authorisation, which is why this request mentions it.
- Who answers to the landlord for a subtenant in Cyprus?
- The tenant. Subletting does not change the lease: the tenant keeps paying rent to the landlord and is responsible for the subtenant's damage or nuisance as for their own. When the tenancy ends, the sublet ends too, so the agreement with the subtenant should not promise a period beyond it.
