Common questions

What counts as normal wear of a rented home under the Moldovan Civil Code?
The ordinary, unavoidable signs of careful use with proper upkeep (art. 1265(2) of the Civil Code): slightly faded walls, flooring worn where people walk, loosened hinges. The tenant does not answer for them. The tenant does answer for damage to the home unless they prove it was not their fault (art. 1284).
Should a tenant in Moldova sign the move-out record if they disagree with the landlord?
Sign it after writing your objections in their section: the record shows what was handed back and when, and each side keeps its rights over what it disputed. If you refuse to sign, nothing proves the date of the hand-back or the keys returned. Take dated photos of every room and of the meters.
What should a tenant do if the landlord keeps the deposit after the flat is returned?
If the record shows the deposit is due and the payment date has passed, send a written demand for the deposit, with a deadline, by registered post with acknowledgement of receipt. If the landlord still does not pay, you can ask for a court order (ordonanță judecătorească) or bring a claim at the competent district court, within the three-year general limitation period.
