Leases, notices and handover records for a rented home in Moldova
In Moldova, the lease of a home is governed by the Civil Code (Law no. 1107/2002, arts 1251–1287) and is made in writing. The fixed-term lease ends on its date; if the relationship carries on after it and neither side objects, it is treated as extended for an indefinite term (art. 1280). The open-ended lease can be ended by either side with three months' notice (art. 1281). For a relative or a friend to live in a home free of charge, the free-use agreement (comodat) follows arts 1234–1241 and can include the owner's consent to registering the occupier's domicile or residence there.
At move-in, the handover record notes the state of each room, the furnishings, the meter readings and the keys; at move-out, the return record compares the home with it, and the tenant does not answer for normal wear (art. 1265). The tenant's notice ends the lease with the statutory or agreed notice, without notice where the home endangers health, or at the end of the term so that it is not tacitly extended; it goes by registered post with acknowledgement of receipt. The law has no rule on deposits: the leases agree their return within 30 days, and the deposit demand gives the landlord 15 days before a court order is applied for.
The documents themselves are in Romanian, and each page describes its document in English. DocMuse's documents for Moldova follow the law applied by Moldova's constitutional authorities. Those authorities do not exercise effective control in the localities on the left bank of the Dniester or in the municipality of Bender, and no document is meant for the bodies operating there.
