Renting a flat in Liechtenstein: notices, deposit, defects and rent
Since 1 January 2017 Liechtenstein's tenancy law has been a chapter of its Civil Code (§ 1090 ABGB) modelled on Swiss law, but its procedure is its own: there are no approved forms and no conciliation authority, and disputes go to the Princely Court of Justice (Landgericht) in Vaduz. Notice on a flat is three months to the end of any month. A tenant ends the lease with the tenant's notice, which a spouse signs for a family home; a landlord uses the landlord's notice, void without the property, the date and, for a family home, separate service on the tenant's spouse or registered partner. The tenant can sue at the Landgericht within four weeks of receiving it to challenge the notice or ask for an extension.
A landlord raises the rent with a written, reasoned notice of a rent increase that reaches the tenant at least 14 days before the notice period begins and never threatens notice; the tenant can challenge it in court within four weeks. A tenant with defects sends a notice of defects with a deadline, asks for a lower rent and, once the deadline has passed and the deposit is announced in writing, may deposit the rent with the court.
Record the flat's condition in a handover record on moving in and moving out. The deposit, at most three months' rent, is held by a bank in the tenant's name: ask for its release from the landlord, or from the bank alone a year after the lease ends if no claim was brought in court. Every document has an English version, and courts and authorities take the German one. DocMuse is neither an authority nor a law firm and gives no legal advice.
